WILD RIVERS TERMS & CONDITIONS
ASSUMPTION OF RISK/WAIVER AND RELEASE OF CLAIMS/INDEMNITY AGREEMENT/SEASON PASS TERMS AND CONDITIONS
ASSUMPTION AND ACKNOWLEDGMENT OF ALL RISKS: I, ON MY OWN BEHALF, AND ON THE BEHALF OF ANY MINOR IN MY FAMILY THAT IS OBTAINING A SEASON PASS OR DAILY ADMISSION THROUGH ME, AS HIS/HER PARENT, KNOWINGLY, VOLUNTARILY, AND FREELY ACKNOWLEDGE AND ACCEPT AND ASSUME ANY AND ALL RISKS, BOTH KNOWN AND UNKNOWN, OF INJURIES OR OTHER LOSS OR DAMAGE THAT MAY BE SUFFERED WHILE ON WILD RIVERS WATERPARK PREMISES, HOWEVER CAUSED, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ACTION, INACTION OR NEGLIGENCE OF ANY OF THE FOLLOWING: 1) WILD RIVERS IRVINE; LLC; 2) WILD RIVERS WATERPARK IRVINE, SPE, LLC; 3) WILD RIVERS WATERPARK IRVINE, LLC; 4) WILD RIVERS WATERPARK IRVINE HOLDINGS, LLC; 5) SURF HILL LLC; 6) SPLASH MANAGEMENT LLC; AND 7) CITY OF IRVINE (HEREINAFTER COLLECTIVELY REFERRED TO AS “RELEASED PARTIES”) . SUCH RISKS INCLUDE, BUT ARE NOT LIMITED TO CUTS AND BRUISES, FALLS, BROKEN BONES, INJURIES TO WRISTS, ARMS, LEGS, FEET, ANKLES, BACKS, HEADS AND NECKS, INJURIES FROM FLIPS OR CONTACT WITH OTHER PARTICIPANTS OR OBJECTS, AND/OR SPINAL INJURIES.
RELEASE AND WAIVER OF ALL CLAIMS: I, ON MY OWN BEHALF, AND ON THE BEHALF OF ANY MINOR IN MY FAMILY THAT IS OBTAINING A SEASON PASS THROUGH ME, AS HIS/HER PARENT, EXPRESSLY WAIVE ANY AND ALL CLAIMS, SUITS OR DEMANDS FOR PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSS AGAINST THE “RELEASED PARTIES”, AND EACH OF THEM, INCLUDING BUT NOT LIMITED TO ANY AND ALL NEGLIGENCE, NEGLIGENT SUPERIVSION, NEGLIGENT TRAINING, AND NEGLIGENT INSTRUCTION. TO THE FULLEST EXTENT PERMITTED BY LAW, THIS WAIVER IS INTENDED TO BE A COMPLETE RELEASE OF THE RELEASED PARTIES FOR ANY AND ALL RESPONSIBILITY FOR PERSONAL INJURIES, PROPERTY DAMAGE OR DEATH SUSTAINED BY ME OR ANY OF THE MINORS ON WILD RIVERS’ PREMISES, WHETHER ARISING OUT OF OR RESULTING FROM MY OR THEIR PARTICIPATION IN ACTIVITIES, USE OF WATER SLIDES, LAZY RIVER, WAVE POOL OR OTHER WATER STRUCTURES OR EQUIPMENT, PARKING LOTS, PREMISES AND FACILITIES. THIS RELEASE APPLIES FOR ANY DATE IN THE FUTURE THAT I, OR THE MINOR(S) MAY VISIT WILD RIVERS FACILITY, AND IS FURTHER BINDING ON THE HEIRS, REPRESENTATIVES AND ESTATES OF THE UNDERSIGNED AND MINOR(S). THE SCOPE OF THIS WAIVER AND RELEASE SPECIFICALLY INCLUDES ANY CLAIMS, DAMAGES, INJURIES, EXPENSES, OR DEATH ARISING OUT OF OR RESULTING FROM ADMINISTERING OF OR FAILING TO ADMINISTER MEDICAL ASSISTANCE.
INDEMNITY: I FURTHER AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES, AND EACH OF THEM, INCLUDING ATTORNEYS’ FEES, AGAINST ANY AND ALL CLAIMS, LAWSUITS OR DEMANDS FOR ANY LOSS, INJURY, DAMAGE, OR DEATH, AS WELL AS PROPERTY DAMAGE, ARISING OUT OF, CONNECTED TO, OR RELATING IN ANY WAY TO THE PARTICIPATION IN THE ACTIVITIES DESCRIBED HEREIN, AND/OR THE PRESENCE ON THE PROPERTY, INCLUDING BUT NOT LIMITED TO ANY LAWSUIT FILED ON BEHALF OF ANY MINOR(S).
RECREATIONAL SERVICES: I FURTHER ACKNOWLEDGE THAT RECREATIONAL SERVICES ARE BEING PROVIDED BY THE RELEASED PARTIES, AND NO SALE, LEASE OR BAILMENT OF EQUIPMENT IS ANY PART OF TRANSACTION HEREIN. AS SUCH, I AGREE THAT NO CLAIM OF STRICT PRODUCTS LIABILITY WILL BE OR CAN BE ASSERTED AGAINST RELEASED PARTIES.

CURRENCY
All prices posted both online and in the park are in U.S. Dollars. No other currency will be accepted.
ELECTRONIC DELIVERY
All ticket purchases including but not limited to Daily Tickets, Season Passes, Parking and Cabana Reservations will be delivered electronically within 30 minutes of purchase. If you do not receive your ticket(s) within 30 minutes of final purchase, please contact info@old.wildrivers.com .

GENERAL CONDITIONS
A Wild Rivers Waterpark Season Pass is valid only at Wild Rivers Waterpark Irvine and grants a revocable license to the registered holder for admission and use of all open rides and attractions (unless restricted by conditions which could ultimately prohibit someone from riding safely, including but not limited to height, weight, age, physical limitations such as pregnancy and heart conditions, or observed inappropriate behavior), on any regularly-scheduled operating day of the season for which it was issued.
A Season Pass is valid for only one visit per day, and an active Wild Rivers wristband is required for same day re-entry. This pass also does not include admission to areas not open to the general public or requiring a separate admission fee. Fees for parking, food, merchandise, games, pay-per-experience attractions, concerts, and special events are not included.
In order to gain entry to the park, a Season Pass, with a photo of the Passholder , taken during processing, must be displayed and validated at park turnstiles. Any attempt to gain admission using a Regular Pass by a guest to whom the pass was not originally issued will result in immediate confiscation of the pass without refund. Each visit is subject to applicable park rules and restrictions. Guests not meeting the Regular Passholder qualifications for park entry will be required to upgrade .
A Season Pass is not valid for private events, park buyouts, park closing due to full capacity or special events at which an additional admission fee is charged. All operating dates and hours are subject to change without notice. All rides and attractions are subject to closings and cancellations for weather or other conditions.
A Season Pass is the property of Wild Rivers Waterpark Irvine SPE, LLC and is non-transferable, non-refundable, non-exchangeable and not valid for cash. A Season Pass may also be revoked without refund and the Passholder removed from the park for any misuse, failure to abide by applicable terms and conditions or conduct detrimental to the park, including theft of property or services, violation of Federal, State and Local laws, assisting any person to obtain unauthorized entry, violation of park rules, safety procedures, vandalism, disorderly conduct, intoxication, and possession of intoxicating liquors (except as properly purchased within the park with valid identification and used in a responsible manner), drugs or weapons.
A Season Pass ID Card is required for admission at all times. If a Season Pass is lost, stolen or forgotten, the ID card can be replaced for a non-refundable replacement fee, or a regular park admission ticket may be purchased at full gate price. A Season Pass may not be used in connection with any other promotional offer or ticket (except specifically designated for Season Passholders). Unauthorized resale is prohibited.
Any additional benefits added to the Season Pass are only valid for redemption exclusively by the registered passholder. Once benefits are linked to a Season Pass, they are non-transferable, non-exchangeable, and not valid for cash. In order for benefits to be redeemed, the Season Pass must be used for admission on the same date.
The registered holder of a Season Pass agrees to these and other conditions of usage, and grants Wild Rivers Waterpark Irvine SPE, LLC permission to use his or her photographic/video image in advertising, promotions, or other publication without payment or compensation to the holder.
In addition to the Terms and Conditions herein, a Season Pass is subject to all Federal, State and local government health and safety orders in effect at the time the registered holder attempts to use a Season Pass to gain entry. All Federal, State and local government orders and related park rules and regulations applicable should be reviewed prior to any attempt to gain admission. No refund will be provided due to any closure, capacity limitation, and/or full or partial shutdown resulting from any Federal, State and local government health and safety orders. Wild Rivers Waterpark Irvine SPE, LLC reserves the right to require a park reservation and valid Regular season pass on the day of entry.
To enter the park, each Guest is required to have an advanced season pass reservation a valid dated ticket for the park on the same date. Park reservations are limited and subject to availability, restrictions, changes and cancellations at any time. Park reservations are non-transferable and void if transferred or sold. Park admission is not guaranteed.
SAFETY AND SECURITY
Guests are expected to follow posted safety signs as well as all instructions of Wild Rivers park staff. Wild Rivers strictly prohibits all guests from possessing weapons of any kind on the premises. This extends to both the park and parking lot.
Illegal drugs and alcohol are not permitted into the park. Wild Rivers does have the legal right to serve alcohol to guests 21 years of age and older. Wild Rivers reserves the right to cease alcohol service to guests exhibiting intoxication and/or aggressive behavior.
REFUNDS
All sales are final, and Wild Rivers does not offer any money-back guarantees. You recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances. Season Passes and Daily Tickets are non-transferrable unless expressly permitted by Wild Rivers.
